1. Who we are
almagift.store (the "Store") is operated by Alma Gift Corp ("Alma Gift", "we", "us"), a Florida corporation based in Miami Beach, Florida. These Terms apply to your use of the Store and to every purchase you make from us. By using the Store or placing an order, you agree to them. If you don't agree, please don't use the Store.
2. Our products
Our candles are handmade using molds, and every order is made to order. Small differences in color, shape, size and finish compared with the photos are part of each piece and are not a defect. Colors may also look different on different screens. Sizes and weights are approximate. We work to describe every product accurately; if we find an error, we will correct it and may cancel affected orders with a full refund.
3. Candle safety
Candles are an open flame. If you light one of our candles, follow the candle safety instructions on the product page and on the product, and never leave a burning candle unattended. If a product page says a piece is for display only, please don't light it.
4. Prices and payment
Prices are in US dollars and can change at any time without notice, but the price you pay is the one shown at checkout when you place your order. Sales tax and shipping are calculated at checkout. Payments are processed by Shopify and its payment partners; we don't see or store your full card number. If a product is listed at a wrong price because of an error, we may cancel the order and refund you in full.
5. Orders
When you place an order, you will receive an email confirming that we received it. We may refuse or cancel an order, for example if a product is unavailable, if there is a pricing or description error, or if we suspect fraud. If we cancel an order you already paid for, we will refund you in full.
6. Shipping, returns and cancellations
Our Shipping Policy and our Return and Refund Policy are part of these Terms.
7. Custom, bulk and event orders
For custom, bulk and event orders we send you a written quote with the price, design, quantity and delivery date. A deposit of 50% is required to start, and the balance is due before we ship. Because they are made for you, these orders can't be returned unless they arrive damaged or are not what we agreed on.
8. Promotions and discount codes
Discount codes and promotions are valid only for the dates and conditions shown, can't be exchanged for cash, and can't be combined with other offers unless the offer says so. We may end a promotion at any time, but we will honor orders placed while it was active.
9. Our content
The designs, photos, texts, logo and other content of the Store belong to Alma Gift or are used with permission. You may not copy, reproduce or sell them without our written permission.
10. Reviews, photos and messages you send us
If you send us a review, photo or message, you confirm that it is yours and truthful. We will ask for your permission before sharing your photo or your name publicly.
11. Using the Store
Please don't use the Store for anything unlawful, to send spam, to interfere with how it works, or to try to access accounts or systems without permission.
12. Third-party services
The Store runs on Shopify and uses other services, such as payment processors, shipping carriers, analytics and social media. Their own terms and privacy policies apply to them, and we are not responsible for their content or practices.
13. Disclaimer
To the extent permitted by law, the Store and its content are provided "as is" and "as available". We don't promise that the Store will always be available or free of errors.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim related to a product is limited to the amount you paid for that product. Nothing in these Terms limits any right you have under the law that can't be limited by contract.
15. Governing law
These Terms are governed by the laws of the State of Florida. Any dispute will be handled by the courts located in Miami-Dade County, Florida, unless the law gives you the right to bring it somewhere else. You may also use small claims court where available.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows the latest version. The Terms in place when you placed an order apply to that order.
